Booking, Payment & Terms & Conditions

These Terms and Conditions apply to all bookings, gift voucher purchases, deposits, down payments, payment plans and purchases made with Sugar-n-Spice Studio ("the Studio", "we", "our" or "us"). By making a booking, purchasing a gift voucher or making any payment, you agree to be bound by these Terms.

1. Eligibility

All clients attending a boudoir photography session must be 18 years of age or over.

To protect both our clients and our business, any client who appears to be under the age of 25 may be asked to provide valid government-issued photographic identification before their photoshoot commences.

Acceptable forms of identification include:

• Passport

• UK Driving Licence

• PASS Accredited Proof of Age Card

• Government-issued National Identity Card

If satisfactory identification cannot be provided when requested, the Studio reserves the right to refuse the session. In such circumstances the booking will be treated as a client cancellation and the relevant cancellation terms will apply.

2. Booking Deposits

A £55 booking deposit is required to secure all photoshoot appointments.

No appointment is confirmed until the required deposit has been received.

The way the £55 booking deposit is treated depends on the type of booking.

All-Inclusive Package Bookings

Where a client has booked an all-inclusive boudoir package, the package price already includes the cost of the photoshoot.

The £55 booking deposit will therefore be deducted from the package price and treated as part-payment towards the package. The client will not be charged a further £55 photoshoot fee.

Photoshoot-Only Bookings

Where a client has booked the photoshoot without purchasing a package in advance, the £55 booking deposit will be used to cover the cost of the photoshoot.

Following the photoshoot, the client may choose whether to purchase individual images or an image package. Any images or products purchased will be charged separately according to the prices applicable at the time of purchase.

Prize, Promotional & Voucher Bookings

Where the cost of the photoshoot has already been covered by a prize, promotion, voucher or other offer, the £55 booking deposit is held solely to secure the appointment.

Provided the client:

• attends their scheduled photoshoot;

• attends their scheduled viewing appointment; and

• complies with these Terms and Conditions,

the £55 booking deposit will be refunded in full at, or shortly after, the viewing appointment.

Refunds will normally be made using the original payment method.

Client Cancellation

If the client cancels their booking for any reason, the £55 booking deposit is non-refundable, regardless of the type of booking.

Failure to Attend

Failure to attend a scheduled photoshoot or viewing appointment without prior agreement ("No Show") will result in the loss of the £55 booking deposit.

Rescheduling

Appointments may be rescheduled up to 5 days before the booked photoshoot without charge.

Appointments rescheduled with less than 5 days' notice will incur a £20 administration fee, payable before the new appointment is confirmed.

Repeated requests to reschedule may require a new booking deposit.

Studio Cancellation

If the Studio has to cancel or rearrange an appointment due to illness, emergency or circumstances beyond our reasonable control, the client may choose either:

• an alternative appointment; or

• a full refund of the £55 booking deposit where the deposit is refundable under these Terms.

3. Gift Vouchers

Gift vouchers are available for purchase from Sugar-n-Spice Studio.

Refunds

Gift vouchers are non-refundable and cannot be exchanged for cash.

​

Validity

Gift vouchers must be:

• booked; and

• redeemed

within six (6) months of the original purchase date unless otherwise stated.

Expired vouchers cannot normally be extended.

​

Transfer

Gift vouchers may be transferred to another individual before they have been redeemed.

Once redeemed against a booking, the voucher becomes non-transferable unless otherwise agreed by the Studio.

​

Availability

Gift vouchers are subject to appointment availability.

Purchasing a voucher does not guarantee a particular appointment date.

​

Booking Deposit

Where a gift voucher covers the cost of the photoshoot, the recipient may still be required to pay the £55 booking deposit to secure their appointment.

Where the recipient attends both their photoshoot and viewing appointment and complies with these Terms and Conditions, the £55 booking deposit will be refunded in accordance with Section 2.

Lost or Stolen Vouchers

The Studio accepts no responsibility for lost, stolen or damaged vouchers.

Replacement vouchers may be issued at our discretion where satisfactory proof of purchase is available.

​

Promotional Vouchers

Competition prizes, discounted vouchers or promotional offers may carry additional conditions which will be published with the promotion.

​

4. Photography Collections

Package prices include only the products specifically listed within that collection.

Where a package includes the cost of the photoshoot, the £55 booking deposit paid to secure the appointment will be deducted from the package price.

Additional products, wall art, albums, prints or digital images are charged separately unless expressly included.

Prices are correct at the time of booking but may change before a booking is confirmed.

5. Viewing Appointment

Clients are expected to attend their scheduled viewing appointment.

Image selections are normally made during this appointment.

Failure to attend without prior notice may require payment of a further booking fee before another viewing appointment is arranged.

6. Interest-Free Payment Plans

Sugar-n-Spice Studio may offer interest-free payment plans over 3 or 4 months on selected purchases.

Acceptance of any payment plan is entirely at the Studio's discretion.

First Payment

The first payment is due during the viewing appointment when the order is placed.

​

Monthly Payments

The remaining balance is payable in equal monthly instalments.

Payments must be made on or before their agreed due dates.

​

Interest

No interest is charged provided payments are made on time.

​

Ownership of Goods

All products remain the property of Sugar-n-Spice Studio until the account has been paid in full.

No albums, wall art, prints or digital images will be:

• ordered;

• manufactured;

• released;

• delivered; or

• supplied

until full payment has been received.

Late Payments

If an instalment is missed the Studio may:

• suspend production;

• delay delivery;

• cancel the payment arrangement;

• require immediate payment of the outstanding balance before continuing the order.

Recovery of Outstanding Balances

By entering into a payment plan, the client agrees to pay all instalments in full.

Where payments remain outstanding after reasonable attempts have been made to resolve the matter, the Studio reserves the right to pursue recovery of the outstanding balance through debt recovery or legal proceedings. The client may also be liable for reasonable recovery costs where permitted by law.

7. Orders

Once products have entered production or have been ordered from our professional suppliers, orders cannot normally be cancelled or altered.

As all products are bespoke and manufactured specifically for each client, refunds will not normally be available unless required by consumer law.

8. Product Variations

Due to differences in printing processes, monitor calibration and the nature of handcrafted photographic products, slight variations in colour, finish and appearance may occur.

These do not constitute faults.

​

​

9. Copyright & Image Use

The copyright of all photographs remains the property of Sugar-n-Spice Studio in accordance with the Copyright, Designs and Patents Act 1988.

Clients purchasing digital images receive a licence for personal, non-commercial use only.

Images may not be:

• sold;

• entered into competitions without permission;

• used commercially;

• altered in a way that misrepresents the Studio's work.

This includes applying filters or editing that significantly changes the appearance of the images.

10. Studio Portfolio & Marketing

Your privacy is extremely important to us.

We will never publish or display your photographs without your express permission.

Where written consent has been provided, the Studio may use selected images for:

• website galleries;

• social media;

• studio displays;

• competitions;

• exhibitions;

• promotional material;

• advertising.

Clients may withdraw future marketing consent at any time by contacting the Studio. This will not affect material already published before the withdrawal request.

11. Client Responsibilities

Clients agree to:

• arrive on time;

• disclose any relevant medical conditions affecting the session;

• follow reasonable safety instructions;

• treat Studio property with reasonable care;

• pay all outstanding balances when due.

Clients are responsible for any damage caused deliberately or through negligence by themselves or anyone attending with them.

12. Limitation of Liability

The Studio will exercise all reasonable care in providing its services.

Except where prohibited by law, our liability for any claim shall be limited to the amount paid by the client for the relevant booking or order.

Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud or any other liability that cannot legally be excluded.

13. Force Majeure

The Studio shall not be liable for failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to:

• illness;

• severe weather;

• fire;

• flood;

• power failure;

• supplier failure;

• equipment failure;

• government restrictions;

• acts of God.

14. Privacy

Personal information is processed in accordance with our Privacy Policy and UK data protection legislation.

​

15. Consumer Rights

Nothing within these Terms affects your statutory rights under UK consumer protection legislation.

​

​

16. Changes to These Terms

The Studio reserves the right to amend these Terms and Conditions at any time.

The version in force at the time of booking or purchase shall apply to that transaction.

​

​

17. Governing Law

These Terms are governed by the laws of England and Wales.

Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
